If your organization has a current, active agreement with Creative Circle addressing your hiring of a Creative Circle candidate, the terms of that agreement apply, to the extent it covers all the hiring scenarios below. If your organization does not have such an active agreement with Creative Circle (or to the extent any below scenario is not covered), the terms below apply.

If your organization or any person or business with whom you share Creative Circle candidate information (“your organization”) hires a Creative Circle candidate (“Candidate”) on a freelance or project basis, you agree to pay, upon invoice, the Candidate’s designated hourly rate multiplied by the number of hours worked for your organization, along with any other applicable charges. Invoices will include payment terms and instructions. If you would like to hire a Candidate on a direct hire basis, please contact us regarding a Direct Hire Agreement.

 

If your organization hires a Candidate directly for any position without working through Creative Circle, whether part time or full time, freelance, project, direct hire, independent contractor, or in any other capacity, within 12 months from the later of the last date the Candidate worked with your organization or the date Candidate’s information was submitted to your organization, your organization agrees to pay Creative Circle, upon invoice, a conversion fee of 30% of the highest of: (a) the gross annualized compensation for the first year of Candidate’s employment with your organization; (b) the gross annualized compensation at which Creative Circle was last billing the Candidate; or (c) in the absence of (a) or (b), the Candidate’s expected annualized first year compensation.

If your organization or any person or business with whom you share Creative Circle candidate information (“your organization”) hires a Creative Circle candidate (“Candidate”) on a freelance or project basis, you agree to pay, upon invoice, the Candidate’s designated hourly rate multiplied by the number of hours worked for your organization, along with any other applicable charges. If your organization hires a Candidate directly for any position without working through Creative Circle, whether part time or full time, freelance, project, direct-hire, as an independent contractor, or in any other capacity, within 12 months from the first date the Candidate’s information was submitted to your organization, your organization agrees to pay Creative Circle a conversion fee of 30% of the highest of: (a) the gross annualized compensation for the first year of Candidate’s employment with your organization; (b) the gross annualized compensation at which Creative Circle was last billing the Candidate; or (c) in the absence of (a) or (b), the Candidate’s expected annualized first year compensation. Except for employment of an independent contractor, the foregoing conversion fee will not apply if your organization enters into an employment relationship with a Candidate 6 months or later from the date the Candidate first began to perform work for your organization through an assignment by Creative Circle.
